Tanzania Safaris

Terms and Conditions

TERMS & CONDITIONS APPLICABLE TO ALL BOOKINGS

Tanzania Safaris is a brand operated by Extraordinary Experience Limited, a company registered and licensed in Tanzania under TALA License No. 034243.

All bookings made through Tanzania Safaris are contracted with Extraordinary Experience Limited. Payments relating to your booking will be made to Extraordinary Experience Limited or through an authorized payment method identified on an official Tanzania Safaris invoice.

These Terms & Conditions set out the rights and responsibilities of both Extraordinary Experience Limited and the traveler.

1. Contract

Your contract is with Extraordinary Experience Limited.

These Terms & Conditions apply to all quotations, itineraries, invoices, correspondence and bookings made through Tanzania Safaris.

Before confirming a booking, you should read and understand these Terms & Conditions and raise any questions with us.

A booking is considered confirmed once we receive the required deposit or, where applicable, full payment.

By making the required payment, you confirm that you have had the opportunity to read these Terms & Conditions and agree to be bound by them on behalf of yourself and all travelers included in your booking.

No employee, guide, agent or representative has authority to alter these Terms & Conditions unless the change is expressly agreed by Extraordinary Experience Limited in writing.

2. Booking Procedures

Extraordinary Experience Limited provides tailor-made safaris, tours and related travel arrangements according to the individual requirements of our clients.

A binding contract comes into existence when:

(a) we receive the required booking deposit; or

(b) where a booking is made within 10 weeks of departure, we receive the required full payment.

Unless otherwise stated on your invoice or booking confirmation, full payment must be received no later than 10 weeks before departure.

If full payment is not received by the required due date, we reserve the right to treat the booking as cancelled and apply the cancellation terms set out in Section 5.

The lead traveler named on the booking is responsible for:

  • ensuring that all members of the traveling party are aware of these Terms & Conditions;

  • providing accurate traveler information;

  • communicating relevant information to all members of the party; and

  • ensuring that all required payments are made on time.

Until the required deposit has been received, accommodation, flights, activities, permits and other itinerary components remain subject to availability.

Certain accommodations or services may need to be booked on a request basis. Where applicable, we will advise you before confirming the relevant arrangements.

If a requested accommodation, service or activity becomes unavailable before confirmation, we will endeavor to provide a suitable alternative.

3. Payments and Payment Security

Payments should only be made using the payment instructions contained on an official Tanzania Safaris invoice or other written payment instructions provided directly by Extraordinary Experience Limited.

If you receive payment instructions that differ from those previously provided, particularly a request to send funds to a different bank account or recipient, you should contact us through a known Tanzania Safaris contact method before making payment.

Extraordinary Experience Limited cannot accept responsibility for funds sent to an unauthorized third party as a result of fraudulent or altered payment instructions that did not originate from us.

4. Medical Conditions and Accessibility

If you or any member of your party has a medical condition, disability, mobility limitation or other circumstance that may materially affect participation in your trip, you should inform us before confirming the booking.

This allows us to advise, where reasonably possible, whether the proposed arrangements are suitable.

Relevant information should be provided in writing.

If we reasonably determine that particular arrangements cannot be safely or appropriately provided, we reserve the right to recommend alternative arrangements or decline the booking.

Travelers remain responsible for consulting an appropriate medical professional regarding their individual fitness to travel.

5. Cancellation by You

Cancellation must be made in writing and will take effect from the date we receive written notification.

Unless otherwise stated at the time of booking, deposits are non-refundable.

Our standard cancellation charges are:

  • More than 70 days before departure: Deposit only

  • 43–70 days before departure: 30% of the total trip price

  • 36–42 days before departure: 50% of the total trip price

  • 29–35 days before departure: 75% of the total trip price

  • 28 days or less before departure: 100% of the total trip price

Certain itinerary components may have stricter cancellation conditions imposed by the relevant supplier and may become partially or entirely non-refundable once confirmed.

These may include, but are not limited to:

  • domestic and international flights;

  • certain lodges and camps;

  • permits;

  • balloon safaris;

  • private charters;

  • special activities;

  • exclusive-use accommodations; and

  • other prepaid third-party services.

Where a supplier imposes special cancellation conditions that differ materially from our standard cancellation schedule, we will endeavor to make those conditions known to you when the relevant service is booked.

Where airline tickets have already been issued, any refund will be subject to the airline's applicable fare conditions.

If your cancellation is caused by circumstances covered under your travel insurance, you may be able to recover applicable cancellation charges from your insurer.

6. Pricing

The price shown on your quotation or itinerary is based on the accommodation rates, exchange rates, park fees, transportation costs, taxes, supplier charges and other known costs applicable at the time the quotation is prepared.

Until the required booking deposit has been received, pricing and availability remain subject to change.

Once the required deposit has been received and your booking has been confirmed, the confirmed safari price will not be increased because of ordinary exchange-rate fluctuations or ordinary supplier price increases.

However, the confirmed price may be adjusted where, after confirmation, a government authority introduces or increases a mandatory:

  • tax;

  • VAT or similar statutory charge;

  • national park fee;

  • conservation fee;

  • tourism levy;

  • concession fee;

  • airport or aviation charge; or

  • other compulsory government-imposed fee applicable to your trip.

Any such adjustment will be limited to the additional mandatory amount applicable to your booking.

We reserve the right to correct genuine pricing or calculation errors before a booking is confirmed. If we identify an error before accepting your deposit, we will advise you of the corrected price before you decide whether to proceed.

If you request changes after your booking has been confirmed, including changes to:

  • travel dates;

  • number of travelers;

  • accommodations;

  • routing;

  • activities;

  • flights;

  • transportation; or

  • other itinerary components,

the trip price may be recalculated to reflect those requested changes.

We will communicate any revised price before confirming a client-requested amendment.

7. Amendments by You

If you wish to change your itinerary after your booking has been confirmed, please notify us in writing.

We will make reasonable efforts to accommodate requested changes, but all amendments remain subject to availability and the conditions imposed by the relevant suppliers.

Changes may result in additional costs.

Significant amendments made within 10 weeks of departure may, depending upon the arrangements involved, require cancellation and rebooking of certain services.

Any non-refundable supplier charges resulting from a requested amendment will be the responsibility of the traveler.

8. Cancellation by Extraordinary Experience Limited

We reserve the right, in exceptional circumstances, to cancel a trip before departure.

Where we cancel a confirmed trip for reasons within our reasonable control, we will normally offer:

  • an alternative trip of a comparable standard, where reasonably available; or

  • a refund of monies paid to us for the affected arrangements.

We may also cancel a booking where the traveler fails to comply with a material requirement of these Terms & Conditions, including failure to make required payments by the applicable due date.

9. Force Majeure

Extraordinary Experience Limited cannot accept liability or pay compensation where the performance of our contractual obligations is prevented or materially affected by circumstances outside our reasonable control.

These circumstances may include, but are not limited to:

  • war or threat of war;

  • civil unrest;

  • political instability;

  • riot;

  • terrorism or threat of terrorism;

  • industrial disputes;

  • natural disasters;

  • wildfire or significant fire;

  • epidemics or pandemics;

  • government restrictions;

  • border closures;

  • closure of national parks;

  • closure or congestion of airports;

  • severe weather;

  • flooding;

  • significant road closures;

  • transportation disruption; or

  • other circumstances that neither we nor the relevant supplier could reasonably foresee or avoid.

Where Force Majeure affects your trip, we will work with you and our suppliers to determine the most appropriate available solution.

Depending upon the circumstances, this may include:

  • modifying the itinerary;

  • postponing the trip;

  • providing an alternative arrangement; or

  • refunding amounts that we are able to recover from the relevant suppliers.

Where a supplier has lawfully retained payment for services affected by Force Majeure, our ability to provide a refund may be limited to the amount we are able to recover from that supplier.

10. Wildlife, Migration and Safari Experiences

Safaris take place in natural environments and involve free-roaming wild animals.

Specific wildlife sightings cannot be guaranteed.

The location, concentration and behavior of wildlife are influenced by natural factors including rainfall, water availability, vegetation, fire, weather, migration patterns and other environmental conditions outside our control.

This is particularly important in relation to seasonal wildlife events such as the Great Wildebeest Migration.

Although we design itineraries based on seasonal patterns, historical wildlife movements and current local knowledge, we cannot guarantee:

  • the precise location of the migration;

  • a wildebeest river crossing;

  • a particular predator sighting;

  • sightings of any specific species;

  • calving activity;

  • hunting behavior; or

  • any particular wildlife interaction.

Our guides will use their experience, local knowledge and available information to provide the strongest reasonable wildlife-viewing opportunities during your safari.

The absence of a particular animal, species, migration event or wildlife encounter does not constitute a failure to provide the contracted safari.

11. Itinerary and Operational Changes

Travel in Tanzania occasionally requires flexibility.

We reserve the right to make reasonable changes to the order or operation of an itinerary where necessary because of circumstances including:

  • wildlife movements;

  • weather;

  • road conditions;

  • park regulations;

  • government restrictions;

  • flight schedule changes;

  • accommodation operational issues;

  • safety considerations; or

  • other circumstances affecting the practical operation of the trip.

Such changes may include adjustments to:

  • game-drive schedules;

  • driving routes;

  • activity times;

  • domestic flight times;

  • accommodation sequence; or

  • the order in which destinations are visited.

Where a confirmed accommodation becomes unavailable for reasons outside our reasonable control, we will endeavor to provide an alternative of a comparable standard and location wherever reasonably possible.

Minor operational changes that do not materially alter the overall nature or standard of the trip will not constitute a significant change to the contract.

If a significant change becomes necessary before departure for reasons within our control, we will inform you as soon as reasonably possible and, where appropriate, offer:

  • the revised arrangements;

  • a suitable alternative; or

  • cancellation of the materially affected arrangements with an applicable refund.

12. Our Responsibilities

Extraordinary Experience Limited accepts responsibility for ensuring that the travel services included in your confirmed itinerary are provided substantially as described, subject to these Terms & Conditions.

We cannot accept responsibility for services that do not form part of your confirmed booking with us.

This includes services independently arranged between you and:

  • hotels;

  • camps;

  • airlines;

  • activity providers;

  • transportation companies; or

  • other third parties.

Information on our website, itineraries and other materials is provided in good faith and is believed to be accurate at the time it is published or supplied.

Travel in Tanzania may involve infrastructure and operating conditions that differ from those in your home country.

Temporary interruptions to services including:

  • electricity;

  • internet connectivity;

  • water supply;

  • roads; and

  • transportation

may occasionally occur, particularly in remote areas.

Extraordinary Experience Limited will not be responsible for injury, illness, loss, damage, expense, delay or other claims resulting from:

  • the acts or omissions of the traveler or another member of their party;

  • a third party not connected with the contracted services;

  • circumstances that neither we nor the relevant supplier could reasonably have predicted or avoided despite exercising reasonable care;

  • Force Majeure; or

  • services that do not form part of your confirmed booking.

Nothing in these Terms & Conditions is intended to exclude any liability that cannot legally be excluded under applicable Tanzanian law.

13. Flights and Other Carriers

Air travel and other commercial transportation are subject to the carrier's own Terms & Conditions and applicable national and international regulations.

Flight times may change after your itinerary has been confirmed.

Unless a flight is operated directly by Extraordinary Experience Limited, we cannot accept responsibility for matters within the operational control of the carrier, including:

  • cancellations;

  • delays;

  • schedule changes;

  • diversions;

  • strikes;

  • baggage delays;

  • lost baggage; or

  • technical or operational decisions.

Where transportation has been arranged by us as part of your itinerary, we will provide reasonable assistance in communicating with the carrier and arranging practical alternatives where possible.

14. Your Responsibilities

Travelers are responsible for ensuring that they possess all documentation required for their trip, including:

  • valid passports;

  • visas;

  • permits;

  • vaccination documentation; and

  • other applicable entry or travel documents.

Travelers are responsible for checking applicable passport, visa, immigration and health requirements sufficiently in advance of travel.

Extraordinary Experience Limited may provide general information regarding such requirements, but this information should not be treated as a substitute for advice from:

  • the relevant government authority;

  • embassy or consulate;

  • immigration authority; or

  • qualified medical professional.

You are responsible for arriving on time for flights, transfers, activities and other pre-booked arrangements.

No refund will normally be provided for services missed because of late arrival, failure to attend, lost travel documents or failure to comply with applicable entry requirements.

Safari travel, walking safaris, trekking and other adventure activities involve inherent risks.

By participating in such activities, travelers acknowledge and accept the ordinary risks associated with travel in natural and remote environments.

15. Travel Insurance

All travelers booking with Extraordinary Experience Limited are required to obtain comprehensive travel insurance appropriate to their itinerary.

Your insurance should provide adequate coverage, where applicable, for:

  • trip cancellation and interruption;

  • emergency medical treatment;

  • hospitalization;

  • medical evacuation;

  • repatriation;

  • travel delays;

  • lost, stolen or damaged belongings;

  • safari activities; and

  • trekking, hiking or high-altitude activities included in your trip.

It is the traveler's responsibility to ensure that the selected insurance policy provides suitable coverage for the specific itinerary.

We reserve the right to request evidence of appropriate travel insurance before departure.

16. Data Protection and Privacy

Extraordinary Experience Limited respects the privacy of our clients and handles personal information in accordance with applicable privacy and data-protection requirements.

Information supplied to us may be shared with third parties where reasonably necessary to arrange and operate your trip.

These may include:

  • hotels and camps;

  • airlines;

  • guides;

  • transportation providers;

  • activity providers;

  • government authorities;

  • park authorities; and

  • other suppliers involved in your itinerary.

We may use your contact information to communicate with you regarding your inquiry, booking and travel arrangements and, where permitted, to provide information regarding our services.

Where a separate Privacy Policy is published on the Tanzania Safaris website, that policy should be read together with these Terms & Conditions.

17. Governing Law and Jurisdiction

These Terms & Conditions, together with your confirmed itinerary, invoice and relevant booking correspondence, form part of your contract with Extraordinary Experience Limited.

The contract is governed by the laws of Tanzania.

Any dispute or legal proceeding arising from or relating to the contract will be subject to the jurisdiction of the courts of Tanzania, subject to any rights that cannot legally be excluded under applicable law.

18. Problems and Complaints

If you experience a problem during your trip, you should notify your guide, Tanzania Safaris representative, camp manager, hotel manager or other appropriate service provider as soon as reasonably possible.

This gives us the opportunity to investigate and attempt to resolve the issue while you are traveling.

If the matter cannot be resolved locally, please contact Extraordinary Experience Limited as soon as reasonably possible.

If the issue remains unresolved following your trip, please provide full details to us in writing within 28 days of your return home.

Failure to report a problem during the trip where it would have been reasonable and practical to do so may affect our ability to investigate the circumstances and provide an appropriate resolution.
